Rice NerdsTM Club Terms and Conditions
The “Rice Nerds Club” is sponsored by Lundberg Family Farms. You may become a member by paying the annual membership fee if you are an adult 18 or older and located in the 48 contiguous US states. Membership eligibility is limited to our existing shipping zones. We are currently unable to ship products outside the 48 contiguous US states, including to Alaska, Hawaii, other US territories, Canada or orders that contain APO, FPO, DPO, or AE addresses. This club is a members-only offering that provides exclusive benefits to members for an annual price (the “Membership”). You will need internet access to access your Membership benefits via your account on www.lundberg.com. Benefits and pricing may change from time to time. Please see the latest on the Club Page.
1. Club Terms. These Rice Nerds Club Terms and Conditions (“Membership Terms”) include the terms and FAQ on the Club Page and supplement our “Terms of Service,” available here: https://www.lundberg.com/policies/terms-of-service. By signing up for a Membership, you agree to be bound by these Membership Terms and remain bound by our Terms of Service, which apply when you use or visit www.lundberg.com. This Membership program is a “Service” we offer for purposes of our Terms of Service. In the event of any conflict between these Membership Terms and the terms on the Club Page, the terms on the Club Page will control as far as available benefits and amount of Membership fee, and these Membership Terms will control as to other matters.
2. Membership Fee; Automatic Renewal. You must pay the annual Membership fee stated at the Club Page at the time of your initial Membership purchase and its renewal to participate in the Rice Nerds Club and agree to these Membership Terms, including automatic annual renewal of your Membership unless you cancel it beforehand. We will remind you that your Membership is set to renew annually by sending an email to your email address in your account created on wwww.lundberg.com 15 days prior to the renewal date. We may change the Membership fee without prior notice to you, but you will receive an email the Membership is renewing with the current fee prior to being charged a renewal. The renewal will be processed to your credit card on file. You may cancel at any time prior to a renewal by doing so though your account or contacting us at hello@lundberg.com.
3. Your Consent to a Recurring Annual Subscription. Memberships renew annually for another year until cancelled. By signing up for the Membership you acknowledge and agree this is how the Membership is set up. The Membership fee is non-refundable but you may cancel renewal of the Membership as indicated above, prior to incurring another annual charge. Taxes may apply on the Membership fee, and any taxes will be added to your order and automatic renewal.
UNLESS YOU CANCEL VIA YOUR ACCOUNT OR NOTIFY US BEFORE THE RENEWAL DATE THAT YOU ARE CANCELLING, OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR MEMBERSHIP WILL AUTOMATICALLY CONTINUE ANNUALLY ON THE ANNIVERSARY OF ITS START DATE AND YOU AUTHORIZE US TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.
4. Membership Account. If you already have an account on www.lundberg.com, your Membership will be accessible through your account. If you do not already have such an account, you will be prompted to create one when you purchase a Membership. You need to have and log-into your account to enjoy your Membership benefits. We do not charge you to create an account. You will need to provide a valid email address to receive Membership notifications. Please secure your account log-in; you are responsible for any activity through your account, whether or not authorized.
You are also responsible to maintain a current valid email address for your account. We are not responsible for misdirected, lost, missed or undelivered notifications based on changes to your email address or any returned or undelivered email resulting from your email provider’s protocols or any failure in internet connectivity or other causes beyond our control.
Your Membership account is personal to you and you alone may use it. You cannot leave your account or benefits to your spouse, heirs, estate, executor or personal representative when you die. If you attempt to transfer Membership benefits in violation of these limits, we reserve the right to void them.
5. Non-Payment. If all eligible payment methods we have associated with your account are declined for payment of your Membership fee, you must provide us a new eligible payment method promptly or your Membership will not be started (for new Memberships) or renewed (for existing Memberships). You will have 3 days from receiving a non-payment notice from us to update your payment method before we cancel a renewing Membership for non-payment. If you desire to rejoin, later, you are welcome to do so by paying for a new Membership but any benefits associated with the cancelled Membership may be forfeited.
6. Changes to Membership Terms. We may in our discretion change these Membership Terms and the other terms of our Membership program and available benefits. Some benefits may not be available everywhere we have members. Any changes will be posted to the Club Page and will be effective as of the date of posting on such page. Your continued Membership after we post updated terms constitutes your acceptance of the changes. If you do not agree to the changes, your only recourse is to cancel your Membership.
We reserve the right to correct errors in Membership benefits descriptions at any time. We do not guarantee that all errors that come to our attention will be corrected.
Any delivery of benefits is limited to within the 48 contiguous United States, including District of Colombia, and excluding Alaska, Hawaii, and U.S. territories and protectorates. We will not ship benefits to another country. Benefits are only deliverable to a physical address, not a P.O. Box.
7. Termination by Us. We may terminate your Membership at our discretion if we terminate the Rice Nerds Club. If we do so, we will give you a prorated refund based on the number of full months remaining in your Membership subscription. We may also terminate your Membership if you fail to abide by these Membership Terms or our Terms of Service. We will not give any refund for termination related to conduct that we determine, in our discretion, violates these Membership Terms, our Terms of Service, or any applicable law, involves fraud or misuse of your Membership, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Membership Terms, or our Terms of Service will not constitute a waiver of any of our rights.
8. Store Credits Expire. As a benefit of your Membership, you may receive store credit in the form of a portion of the purchase price being credited back to you (not applicable to shipping fees or taxes). Store credits can be used only to purchase products or services on www.lundberg.com. You must be logged into your Membership account for any store credits to apply; if you check out as a guest, you will lose any applicable store credits. Store credits may also be forfeit in connection with any return or refund. Any store credits you do earn will expire 90 days after the date you earn or receive the store credit. Credits will typically post upon completion of purchase. If you do not use your store credit before it expires, you forfeit your right to use it. Store credit does not have independent value outside of serving to reduce the cost of your future purchases on www.lundberg.com and may not be exchanged or redeemed for cash or gift cards. We may but are not required to notify you that your store credit is expiring.
9. How we Communicate with You; Contact Us. We will communicate with you by email regarding Membership updates and notices. We may also post messages to your account. If you need to contact us regarding your Membership, you may contact customer service at hello@lundberg.com. We respond to messages during our service hours Pacific Time Monday-Friday from 8am-4pm, excluding holidays. Requests will be answered in the order received and may be delayed depending on volume of requests.
By obtaining a Membership, you agree to receive electronic communications from us related to the Membership by email and/or posting to your account or the Club Page and that such communications will be an effective means of notice between us. You are free to unsubscribe from our Membership marketing emails from within the email but may miss timely notices for members if you unsubscribe.
10. Limitations of Liability. IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS SET FORTH IN OUR TERMS OF SERVICE, OUR TOTAL LIABILITY IN CONNECTION WITH YOUR MEMBERSHIP, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID TO US. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR MEMBERSHIP.
11. Dispute Resolution and Choice of Law and Venue. The parties shall attempt in good faith to resolve any dispute arising out of or relating to these Rice Nerds™ Terms and Conditions by negotiations between executives who have authority to settle the controversy. Any party may give the other party written notice of any dispute not resolved in the normal course of business. Within five (5) business days after delivery of said notice, executives of both parties shall meet (either via videoconference or in person) to exchange relevant information and to try to resolve the dispute. If a) either party fails to cooperate with such meeting (such as by failing to respond to the request to meet, not attending the meeting, or not acting in good faith to try to resolve the dispute) or b) the parties fail to resolve their dispute and do not agree to keep trying to resolve the matter informally, each party shall have the right to pursue such further remedies at law or in equity as it deems appropriate. These Rice Nerds™ Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of California without giving effect to its choice of law provisions.
12. Privacy Notice. We use your personal information provided to us to maintain your account with us, to administer this Membership program, communicate with you about it, respond to your requests related to your Membership, improve and troubleshoot the Membership program.
